BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: A tract of land located in the 1100 block of Dave L. Brown Drive, being on the southwest line of Dave L. Brown Drive southwest of East Brainerd Road. An unplatted tract, being the property described as Tract 1 in deed book 4427, page 37, ROHC. Tax Map No. 158G-B-1. from R-1 Residential Zone and R-3 Residential Zone to R-4 Special Zone. 0C SECTION 2. BE IT FURTHER ORDAINED, That this rezoning shall be subject to the following conditions: 1. Landscaping be done in accordance with FutureScape landscaping conditions, a copy of which is attached hereto and made a part hereof by reference; 2. The applicant will purchase the right-of-way necessary for the realignment of Dave L. Brown Road and donate the same to the City so as to create a cross intersection at East Brainerd Road for the safety of the traveling public without which an increased hazard would be created by the increased traffic inherent in the project for which the rezoning is being done; 3. There shall be a maximum of 320,000 square feet of office space; and 4. There shall be a maximum of 160 multi-family units. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, as provided by law.
